All participants, spectators, parents, guardians utilizing the Mesa Tennis & Pickleball Center must sign the City of Mesa Waiver. -----------WAIVER: In consideration for being permitted to participate in City of Mesa (“City”) activities or programs, or utilize and be present on City facilities, as a participant, spectator, or parent or guardian of a participant (hereinafter “USER”), permis-sion is granted to participate in, or be present at, City activity(s) and program(s)listed on this form. USER understands, acknowledges, and agree that they may be photographed and/or videotaped for promotional purposes. USER further understands, acknowledges, and agrees that there are inherent dangers and risks of physical injury in participating in City activities or programs and or utilizing and being present on City facilities including, but not limited to, exposure to the novel coronavirus (COVID-19) to the USER. Considering all possible inherent dangers and risks, on behalf of the USER and myself, I voluntarily waive, release, discharge hold harmless, and agree to defend and indemnify the City, its employees, supervisors, elected and appointed officials, agents, representatives and volunteers from all claims, losses, liability, or expense of any kind USER may experience or incur in connection with USER’s participation in City activities or programs, or utilizing or being present on City facilities. Furthermore, I give consent for emergency treatment to the USER. This waiver does not extend to any such claim or liability that is caused solely and exclusively by the gross negligence of the City of Mesa or its employees, elected or appointed officials, agents, representatives, and volunteers. This Waiver shall remain valid and in full force and effect, and may be relied on by the City, for all activities or programs listed below and for all future activities or programs, until such times as the USER notifies the City in writing that they wish to revoke the Waiver.
